AI & Copyright: Reduce the Risk of Getting Sued. Improve the Odds of Winning If You Do.

Cyn Mobley MBA JD

Update: as we go to press, AI companies are stepping forward to promise users indemnification/reimbursement/protection from copyright infringement lawsuits. How this will all shake out is anybody's guess at this point. I'll update you as cases are decided.

Worried about AI and copyright? What is Fair Use, anyway? Are you going to get sued if you use AI to write a novel or graphic story? Where is the law going? Can you copyright your AI work?

AI is introducing new complexities into the field of intellectual property. The law is NOT settled and there are no bright line tests -- yet -- for what material is truly copyrightable, what consitutes infringement, and where the courts and Congress will end up. I suspect there will be new laws outlining how copyright law should treat AI creations, but that's in the future.

What you need to do NOW is understand the categories and prepare for litigation. This short book covers the basics, including how to prepare for potential litigation, and uses flow charts and checklists to make sure you lessen the risk whenever possible by using correct prompts and records. The last section includes a comprehensive list of previous copyright cases along with links, so you can get a feel for how courts are approaching the issues.

The bottom line: the law is unsettled, so expect the best but prepare for the worst.
